All of a sudden this attorney is an epidemiologist/toxicologist??? I hope the affected locals’ karma isn’t permanently shifted…they may come back as cogent humans.

What a lot of of people do not understand is that attorneys need to become very familiar with whatever experts the case may require. To take a deposition of an expert, you need to be up on the field, or the expert will blow you off with “expert speak”.

You’re correct. This guy is shrewd and has his smooth palaver down for the media; however, I have a hard time believing that a municipality like Encinitas would have cleared this site without an elevated degree of caution. Misinformation about unpronounceable chemicals spreads through a neighborhood like a hemorrhagic virus. Before you know it, exhaust fumes from I-5 begin to cause terminal cancers. Please reference the insipid and infamous case brought by Erin Brokovich (Masry) against PG&E.

Anyone know if anything further ever came of this? Anyone have any thoughts on how the potential chemical risk, or the on-going construction over the next couple of years, will affect the short term value of the surrounding homes?

I haven’t heard anything else, but owners in the area should feel the need to disclose it.
