Yes, that is fine, no disclose is necessary. If a dozen bad guys step on your lawn, and you kill all of them, no disclosure is necessary as long as none of them lived with you. The police might have something to say though!
If the deceased was not an occupant, had HIV or AIDS, or died more than three years ago, you do not have to disclose their death on the property.
I’m a little mixed up…
If a death occurred last year in the house, and the person who died had HIV or AIDS, must the death still be disclosed? Or just not that the dead person had HIV or AIDS?
How about if I directly ask the seller “Has a person died in this house?” and “Did the dead person have HIV or AIDS?” Is the seller legally allowed to say NO to both questions?
Disclose, disclose, disclose… The neighbors will always tell!!
I think the C.A.R. is so paranoid about us discriminating against HIV/AIDS deaths that they have lost sight of the real intent of the law.
